The Michigan foreclosure process typically follows a non-judicial path, but can also proceed judicially in some cases. Here's a breakdown of the general process:

Non-Judicial Foreclosure (Most Common in Michigan)
  1. Default
    • The borrower misses mortgage payments, typically 3+ months behind.
  2. Notice of Default and Intent to Foreclose
    • The lender must send a notice informing the borrower of the default and provide time to catch up on payments (usually 30 days).
  3. Publication of Notice of Sale
    • If the default isn't resolved, a foreclosure notice is published in a local newspaper for 4 consecutive weeks.
    • A copy of the notice must also be posted on the property at least 15 days before the sale.
  4. Sheriff’s Sale
    • The home is sold at a public auction to the highest bidder, often held at the county courthouse.
  5. Redemption Period
    • The homeowner typically has 6 months to redeem the property (buy it back by paying off the debt in full).
    • If more than two-thirds of the original loan has been paid, the redemption period may extend to 12 months.
    • If the property is abandoned, the redemption period can be reduced to 30 days.

Judicial Foreclosure (Less Common)
  • Initiated via a lawsuit by the lender.
  • Handled through the court system and may take longer.
  • Ends with a court-ordered sale.
